چکیده
|
|
قانون مدنی در باب وظیفۀ شوهر حکم صریحی در مورد سکونت در منزل مشترک ندارد، ولی عرف مسلّم آن را از لوازم حسن معاشرت با زن میداند.علاوه بر این، با توجّه به الزام قانونگذار به سکونت در منزل مشترک در دوران عدّه رجعیه، به نظر میرسد رویۀ عملی جاری بین زوجین خلاف این قاعده است و زوجین پس از اجرای صیغۀ طلاق از یکدیگر جدا شده و بهندرت، موردی پیش میآید که یکجا سکونت نمایند. حتی در نظر عرف عامه سکونت زوجین در منزل مشترک پس از اجرای صیغۀ طلاق امری مذموم تلقی میشود و در عمل، امکان اجرای این حکم وجود ندارد. سوال مورد بحث این است که در صورت امتناع یکی از زوجین از سکونت در منزل مشترک، چه در ایام نکاح و چه ایام عده طلاق رجعی،آیا در عمل امکان الزام آنها به اجرای این حکم وجود دارد؟ ضمانت اجرای آن چیست؟ در خصوص ماهیت سکونت زوجین در منزل مشترک، گرچه سکونت مشترک مقتضای اطلاق عقد میباشد و تراضی خلاف آن امکانپذیر است، اما این سکونت در منزل مشترک به نوعی حق شوهر نیز محسوب میشود و یکی از لوازم حسن معاشرت است و اسقاط آن بهتنهایی ممکن نبوده و باید با تراضی زوج باشد.

In addition, according to the legislative requirement to live in the same house during retroactive period. it seems that the current practice between couples is contrary to the rule and divorced couples contract implementation and rarely something happens that they live together. Even the popular custom of couples living in the same house after running contract divorce is seen as a reprehensible thing and in practice; there is no possibility of execution. The question at issue is that if one spouse refuses to live in the same house, both during the marriage and revocable divorce a few days, Is there the possibility of requiring them to carry out the sentence? What are the sanctions?
